The defined terms in these B2B Terms and Conditions shall have the same meaning as provided for in the Terms and Conditions.
Terms and Conditions apply also for this Referral Program.
1 Definitions
“ClaimAir”: ClaimAir s.r.o., a limited liability company, with its registered place of business at Dlouhá 730/35, 110 00 Praha 1, Czech Republic, ID: 04839692, incorporated in the Commercial register maintained by the Municipal Court in Prague, Section C 254500.
“ClaimAir Website”: A website of ClaimAir located at http://www.claimair.com or http://claimair.com
“Referral Program”: A program specified by these Terms and Conditions.
“Referral Partner”:i A person that enters into the Referral Program by registering on ClaimAir website.
“Referral Link”: A hyperlink with a unique designator that is used by Referral Partner to route its customers to the ClaimAir Website. It enables ClaimAir to distinguish a source of traffic for purpose of the Referral Program.
“Referral Report”: A report in a form of a spreadsheet summarizing the activity of visitors of the ClaimAir Website coming through the Referral Link.
“Client of the Referral Program”: Client of ClaimAir who registers a Valid Claim on the ClaimAir Website through the Referral Link.
“Valid Claim”: Submitted (registered) claim through the Claim Form containing all necessary details and documents as stated in the general terms of ClaimAir. The claim cannot be a fiction and it has to be a real issue caused by a flight disruption or baggage mishandling which Entitles the Client of the Referral Program to a compensation.
“Entitlement to a compensation”: Proven eligibility to a compensation based on the relevant legislation.
2 Referral Program
Referral Link is generated to a Partner once registered the main ClaimAir account and can be found on www.claimair.com/invite
The Referral Partner can provide its customers or users with the Referral Link to route them to the ClaimAir Website with a goal to use Services of ClaimAir. Once the Client of Referral Program visits the ClaimAir Website, a tracking cookie is set within the internet browser of the Client of Referral Program. The cookie is stored for 1 day which means that regardless the type of future visit (direct, organic, referral, etc.) the Client of Referral Program consequently makes within the 1 day, the Referral Program applies.
ClaimAir will provide the Referral partner with the Referral Report automaticaly through the website.
ClaimAir reserves the right to terminate the account of the Referral Partner without needing to state any reasons. It may happen in a case when the Referral Partner’s site is of a poor quality, or if the Referral Partner breaches any laws or rights. The Referral Partner is always informed in writing if such termination happens.
The Referral Partner may terminate the Referral Program at any time by informing ClaimAir in writing.
3 Referral Fee
The Referral Partner is granted a fee amounting to €10 for each Valid Claim that was registered through the Referral Link.
The date of entitlement of the Referral Partner to the Referral fee is the day when the received Claim is by ClaimAir employee evaluated as Entitled for Compensation. The entitlement will be evaluated within 15 days.
4 Payments
ClaimAir will disperse the payment to the Referral Partner within 10 (ten) days after the end of a month when the Claim was evaluated as Valid.
The payments are transferred to the Referral Partner by means specified in the Section 9 - Payment Processing of the Terms and Conditions while the same conditions apply.
All payments are based on invoicing system controlled by ClaimAir and provided to Referral Partner. All payments are stated inclusive of VAT which must be specified in advance by the Referral Partner. The Referral Partner is solely responsible for accounting for such VAT.

6 Intellectual Property
The ClaimAir Website and its original content, features and functionality are owned by ClaimAir and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
The Referral Partner warrants that it will not breach any and all intellectual property rights that could damage ClaimAir.
